TERMS & CONDITIONS
PLEASE READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS THAT BOUNCY BOUNCY BOO CASTLE HIRE INSIST UPON.
DO NOT SIGN THE DECLARATION ON THE BOOKING FORM UNLESS YOU AGREE IN FULL.
1. Definitions
1.1 – “The Client” -refers to the hirer, person or organisation placing a order for equipment or entertainment with "The Company”.
1.2 - “The Company” - refers to Bouncy Bouncy Boo Castle Hire.
2. Ordering
2.1 - By placing an order either via The Company website, verbally over the phone, via email or any other method, it is deemed and understood that The Client fully agrees to and is bound by these Terms & Conditions and enters a binding contract with “The Company” on signature.
2.2 - When placing a booking please ensure The Client has the landowners/venues permission to include use of inflatables or any other booked item. Copies of The Company insurance, inspection reports, risk assessments, disclaimers and method statements are available to view on The Company website (www.bouncybouncyboocastlehire.co.uk) and these should be read prior to booking. If you have any queries, please contact The Company prior to booking.
2.3 – A 25% non-refundable deposit is taken on all bookings. This booking fee covers The Company administration costs when reserving your equipment.
3. Location
3.1 - The space required to operate the equipment safely will be larger than the equipment size and this information can be found on The Company website under the ‘size’ tab on each individual product description. It is the responsibility of The Client to check that there is enough space and the correct surface to install and operate the equipment booked. Inflatables booked for outdoor use must be erected on real grass to ensure they can be anchored down correctly and meet the requirements of BSEN 14960:2019-1 fully. The Company does not install equipment on any other surface outdoors.
3.2 - On delivery, if the surface type, equipment area or access to the house/venue is not suitable, the equipment will not be set up, delivery will be refused, and the full charge will be due from The Client. This includes any provisions The Client has failed to inform The Company of, before booking, including: stairs, obstructions and excess distance to site (over 50m) etc.
3.3 - On delivery the equipment will be set up at the agreed location and will not be moved once erected. Under no circumstances should The Client attempt to move, relocate or reposition the equipment as this could then make the equipment unsafe and cause serious injury.
3.4 - It is the responsibility of The Client to make available suitable security and crowd control measures prior to the start of and during the event. This includes, but is not limited to, security fencing around any generators and/or blowers, cable covers and supervision.
3.5 – It is the responsibility of The Client to inform the delivery team prior to the start of delivery of any underground services present on site. Much of The Company equipment uses metal pegs, up to 500mm long, which are inserted into the ground to secure the equipment safely. The Company will not accept responsibility or cost of damage caused by these.
3.6 - Where the delivery needs to go through a house, property or any other area, The Company staff will take the utmost care but it is the responsibility of The Client to ensure that there is clear access from our delivery vehicle to the required site. Any carpets should be covered with a protective material. Any damage caused will not be accepted by The Company as result of failures by The Client to provide a clear access.
4. Delivery and Collection
4.1 - Home Addresses – The Company delivery times will be between 7:00am-12:30pm and collection times between 6:00pm-9:30pm. Unfortunately, The Company cannot guarantee specific times as these are calculated by postcode routes which vary each day depending on the area The Company are operating in. The Company offers an overnight option, which guarantees you the use of booked equipment for the whole evening and collection will be from 8am the following day (The Company is unable to guarantee a specific time). This is charged at £30 per booking (not per item hired). Please note on overnight bookings the area must be secure, locked overnight and any electrical elements, fans and cables etc must be removed and stored within the premises.
4.2 – Venues - If the event is to be held at a venue and The Client requires exact times, then please fill out the 'venue use only' section on The Company booking form. The Company requests The Client allows 1 hour access time either side of the event to allow The Company enough time to set up and pack away. Please note The Company has a last venue collection time of 9.30pm. Do not fill this section in if The Client is booking for a home address as the times will be ignored.
Please note all times are approximate.
4.3 - All services and equipment booked will be delivered, inspected and set up on site by The Company delivery team.
4.4 - Please ensure there are adequate entrance points regarding size of the equipment The Client is hiring. Some of The Company equipment, such as larger inflatables, require at least a 1m access point or may even need The Company delivery team to drive direct onto the site or installation point. The required access width for each item of equipment can be seen under the ‘size’ tab, on The Company website, on each product listing.
4.5 - The Client must not refuse the collection of the equipment for any reason.
4.6 - All Company items and equipment are left in the responsibility and care of The Client from the time they are delivered until the time that they are collected. If collection is delayed for any reason The Client remains responsible until the items are collected.
4.7 – The Company delivery team has strict and tight delivery schedules and must be able to commence set up of the equipment immediately when they arrive on site. Any delays will become chargeable at a rate of £10 per every ten minutes or delivery refused and no refund given.
4.8 – The Company offers an overnight hire service, and this sometimes means that The Company equipment can be collected and then delivered either wet or dirty. This may lead to the equipment being cleaned or wiped down on site at the next delivery or be left to dry. Please allow at least 1 hour before the event for this just in case.
5. Delays/Breakdowns
5.1 - All delivery and collection times are approximate, and The Company will always try to ensure The Company delivery teams run on time and within their delivery time slots. However, should any situations or issues arise outside of The Company control, for example traffic problems, delays at previous deliveries, vehicle breakdowns, etc. The Company cannot be held responsible or liable for any losses or costs incurred by The Client. The Company recommends that The Client allows 1 hour either side of your delivery and collection to ensure the smooth running of the event.
5.2 - In the event of any mechanical or breakdown of equipment either before or during the event which prevents or limits The Company to fulfil the contracted obligations, The Company liability shall be limited to a pro rata refund of any monies paid in relation to the contracted item or equipment to which The Company are unable to provide. Where a breakdown occurs during an event, a pro rata refund for the remaining time booked will be applied based on the start and finish times The Company has from The Client. Any refund will also be limited to the specific item at fault and not the whole booking. This also includes generator failure, only being limited to the cost of the generator affected and not any of the items to which it is due to power. The Company highly recommends the use of additional backup generators or backup power sources.
5.3 - All breakdowns or faults must be reported to The Company, as soon as possible, via phone by The Client. The equipment should not then be used unless advised by The Company that it is safe to do so. The Company will dispatch, where possible, a Company representative to inspect the fault, provide a replacement subject to availability, and aim to fix or replace within two hours of reporting the fault. Any reduction of the fee is at the discretion of The Company and limited only to the percentage of time the equipment is inoperable.
6. Equipment and Ownership
6.1 - All sizes and measurements quoted are approximate and are to the best of The Company knowledge.
6.2 - All equipment remains the property of The Company.
6.3 - The Company reserves the right to alter, amend or change the product specifications without prior notice.
6.4 - The Company reserves the right to substitute any booked equipment or service with another piece of equipment or service of a similar type and value without prior notice in the event the booked equipment or service become unavailable. The Company will always attempt to advise of this as soon as practicably possible.
6.5 - The Company reserves the right to use any images or photos of our equipment or service regardless of whom takes the photo and where it is displayed. The Company will not seek permission to use these, and they may be used within The Company future marketing efforts or product images. This also includes any images taken by The Company, their employees, or representatives.
7. Power requirements and Generators
7.1 - Most of The Company equipment requires a power supply in order to operate. This is normally taken from a household 13amp 3 pin plug or a 16amp socket. The number of sockets required will depend on the type and number of equipment ordered. If The Client is unsure of the power requirement for the order, please check with The Company office. The Company uses extension leads of 25m to connect the power and the equipment. These can be doubled up to a maximum length of 50m after this a generator would be required.
7.2 If using a generator our equipment requires 16-amp sockets. It is the responsibility of The Client to ensure that the generator rating is powerful enough for the equipment hired and there are the required amount of 16amp sockets needed with suitable leads and connectors. The Company also strongly recommends the use and booking of a backup generator in case The Client experiences any issues.
7.3 - Any generators on hire may require refuelling during the hire period. The Client must ensure a ‘competent person’ is able to do this and that regular checks on the generator fuel levels are carried out and they should not be allowed to go any lower than ¼ of a tank. The Client is responsible for the safe storage of spare fuel.
8. Health & Safety and Supervision
8.1 - When placing a booking The Client must have checked and understood all Health & Safety documentation from the Company and from the venue before the hire can go ahead. Copies of The Company insurances, inspection reports, risk assessments, disclaimers and all other documentation are available to view and download on The Company’s website. If you have any queries, please contact The Company before booking.
8.2 - All of The Company policies and insurances are available to view on The Company website and can be downloaded. However, due to renewal or inspection dates these may become out of date for the event date. Once new documentation is received these will be updated on The Company website.
8.3 – Disclaimer – All persons using The Company equipment do so at their own risk.
8.4 – Safe Use, Supervision and Monitoring
• Appropriate clothing must be always worn by all users of The Company equipment. This includes making sure all users wear socks and all exposed skin is covered to avoid injury or friction burns. During hot weather inflatables and PVC can become extremely hot. If the inflatable becomes too hot it must not be used until the temperature has cooled.
• All inflatables are intended for use by either children, adults or all ages. Each product suitability can be found on the ‘suitability tab’ on the individual product listing on The Company website. NO person should use any equipment unless they meet the required ‘user height’.
• A responsible adult, over the age of 18, must always supervise the equipment during use. Certain or larger pieces of equipment may require additional supervision with at least one supervisor at each inflatable entrance and exit. If The Client is unsure of the number of supervisors they will require, they must contact The Company prior to the event.
• The Client must ensure the equipment is not overcrowded, and limit numbers according to the size of participants. Always avoid a mix of large and small participants at the same time. User heights and numbers can be found on the ‘users’ tab on The Company website for each individual product and on the front of each inflatable.
• DO NOT allow anyone to bounce on the front safety step as others could easily ‘bounce off’ the inflatable and be injured. The step is there to assist users to get on and off!
• Ensure that no participant with a history of heart, neck or back problems, high blood pressure, joint or bone weakness or any person with a history of known medical issues are allowed to use the equipment. Any participant who feels unwell during use should be removed from the equipment immediately.
• ALL shoes, glasses, jewellery and badges etc MUST be removed before using the equipment.
• NO face paints, party poppers, confetti, coloured streamers, silly string, food, drink, sweets, chewing gum, pets, toys, barbeques, cigarettes, shoes or sharp objects etc are to be allowed on or near the equipment. This will avoid both choking hazards and potential soiling of the equipment. Any soiling damage will be charged as per contract. The Company cleaning charge is normally £50.00 but may be increased depending on the severity of any soiling.
• Climbing, hanging or sitting on side walls is DANGEROUS and MUST NOT be allowed.
• Participants should not be pushing, colliding, fighting, attempting somersaults, wrestling, running or behaving in a manner likely to cause injury, damage or distress to others on the equipment. Equipment is used entirely at the participants own risk.
• DO NOT allow any participant to be on the inflatable during inflation or deflation as this could damage both the equipment and injure the participant.
• Ensure a safety zone of 6 feet (2 metres) around the equipment is kept clear at all times.
• All inflatables should not be used in winds above 24mph or heavy rain and should be switched off immediately. After rain showers, any wetness, including bubbling (which is normal) can be dried with the aid of a towel.
• In the event that the blower stops working, ensure ALL users exit the inflatable immediately. Make sure the blower tube has not come loose, the deflation zip is still closed and that nothing is obstructing the blower. Failing all this, please contact The Company for further assistance.
• Always use the plug provided. Only use electrical equipment supplied by The Company, as all electrical equipment is fully tested to the appropriate Health and Safety Guidelines by a qualified electrician and fitted with British Standard approved connections. These connections are splash proof and can be left out in wet weather although do not allow them to become submerged in water. The use of any other electrical equipment is entirely at the risk of The Client and is considered misuse of The Company equipment hired.
• Do not allow any person to interfere, adjust, move or repair any electrical item, even if qualified to do so. Failure to do so may result in additional cost for the replacement or repair of damaged parts.
• Any damage to equipment caused by misuse (including moving hired equipment after delivery), neglect, loss or failure to follow these conditions, shall deem The Client liable for full repair or replacement costs in addition to any loss of business as a result of such loss or damage as per the hire contract.
• Any accidental damage to the equipment hired shall be circumstantially assessed by the owner of the Company and could result in The Client being liable for full repair or replacement costs if The Company deems the accidental damage could have been avoided. For example - if equipment has been moved or tampered with unnecessarily.
• Any issues found with the equipment must be reported on discovery NOT at the end of the hire period so a member of the Company staff can return and assess the issue. Failure to do so will negate any possible refund or exchange of equipment. All issues will be assessed by a member of The Company staff to determine the cause of the issue. If the cause is deemed to have occurred during time of hire (after delivery), The Client will be liable for full repair or replacement costs in addition to any loss of business because of such loss or damage as per hire contract.
8.5 – The above is in conjunction with our risk assessments, which can be downloaded from The Company website.
8.6 – The Company reserves the right to remove or cease operating any equipment where it is felt the conduct of users endangers the safety of other users or for any other reason The Company may see fit. In these cases, no refund will be offered.
9. Liability and Insurance
9.1 - The Company carries 5-million-pound public liability insurance. The Company policy covers The Company, its employees and equipment. It does not cover The Client. It is the responsibility of The Client to ensure that they have adequate liability insurance cover in place to cover the participants and the public.
9.2 - The Client agrees to indemnify The Company for any damage or theft of The Company equipment whilst on hire.
9.3 - The Client agrees to indemnify The Company from any claims including, but not limited to, property damage, accident or injury claims for users or the public.
10. Weather
10.1 – It is The Company policy to turn up to all bookings regardless of cold, wet or hot weather, and to provide The Client with the equipment as promised. The Company cannot be held responsible for adverse weather on the day and no reduction in The Company charges will be offered.
10.2 - If hiring inflatables, none of The Company equipment can be operated in wind speeds exceeding 24mph. The inflatable should be unplugged until the wind speed reduces. This is to ensure The Company fully complies with the European Standard and to ensure all The Company equipment is operated within safe conditions and minimise the risk of accident or injury.
10.3 - During periods of heavy rain The Company equipment must not be used. The Client must wait for the period to pass and then dry all equipment before using again.
11. Quotes, Deposits, Payments, Balances and Prices
11.1 - All prices listed on The Company website are subject to change without any prior notice.
11.2 - All written quotations are valid for 14 days.
11.3 - All orders require at least a 25% deposit and must be paid at the time of booking.
11.4 - All deposits and payments made are non-refundable and will be lost on cancellation.
11.5 - The Company is unable to offer any credit facilities, so all remaining balances must be paid in full either before the event or upon delivery.
12. Cancellation
12.1 - Cancellations or amendments must be completed 24hrs before The Client booking. The Company does not charge a cancellation fee if cancelled within this time. All deposits and any payments made are non refundable in the event of cancellation. Once delivery has been completed (this includes when early delivery has been accepted), there will be no option for any refunds or date changes.
12.2 - Cancellation by The Client includes incorrect surface type stated, insufficient access width, inadequate hire space, failure to answer the door or inability to gain access to the venue together with any other items listed in The Company Terms & Conditions as stated and are deemed to be the responsibility of The Client. All deposits and any payments made in these instances are non-refundable. If The Client cancels on the day of the booking, then the full booking fee will be charged.
12.3 – Cancellation due to Health & Safety reasons including wind speeds over 24mph – bookings are to be moved to a future date agreed by The Company and The Client, subject to availability.
12.4 - Cancellation by The Company includes defective equipment, vehicle breakdown or staff absence. The Company will always attempt to find an alternative option to continue with the booking, but in the rare circumstance that The Company may have no other choice but to cancel, a full refund of any monies paid will be issued.
12.5 - All contracts between The Client and The Company are subject to contract force majeure.
13. Complaints and Problems
13.1 In the unlikely event that The Client is unhappy with any aspect of The Company equipment or services provided then please make your delivery team aware during set up.
13.2 - Should The Client experience any problems during the event or is unhappy in any way, The Client must report this as soon as possible via phone, in order for The Company to attempt to rectify the issue. Any claims made after the hire period will not be accepted.
13.3 - Should any accidents or injuries occur during the hire The Client must report this as soon as possible to The Company office, via phone and follow up via email for The Company records. Failure to do this will negate any further action.
